1. About this document
1.1. Acceptance of terms
TuitionPTM.in website (the "website") owned and operated by "SGNR Softwares LLP" is an internet based platform to connect students/guardians with teachers/institutes. We do not operate any of our own tuition centers / institutes. Through the website TuitionPTM.in, we shall provide you ("user") teachers/institutes related information like name, contact, address, their experience and other details. This service of searching teachers may be availed by the user or their family members through their account.
These Terms of Service (the "Terms") are intended to make you aware of your legal rights and responsibilities with respect to your access to and use of the TuitionPTM.in website. These Terms are effective for all existing and future users of TuitionPTM.in.
The terms and conditions (the "terms & conditions") governs the use of the services (the "services") that are provided and made available on the website / app. Before using the website / app, please read the terms and conditions carefully.
Use of the services and the TuitionPTM.in site constitutes knowing acceptance and acknowledgement of this user agreement and concluding a legally binding contract with TuitionPTM.in.
For the purpose of these terms of use, wherever the context so requires,
(i) the term "you" or "user"or"students" or "guardians" or "teachers" or "institutes" shall mean any natural or legal person or entity including accessing or using the services provided on this website;
(ii) the term "we", "us", "our" shall mean the website / app and/or the company, as per the context.
(iii) "Content" will include (but is not limited to) reviews, images, photos, location data, and all other forms of information or data. "Your content" or "User Content" means content that you upload, share or transmit to, through or in connection with the Services, such as likes, ratings, reviews, images, photos, profile information, and any other materials that you publicly display or displayed in your account profile.
(iv) "Third Party Content" means content that comes from parties other than TuitionPTM.in or its users and is available on the Services.
(v) "Teachers/Tutors/Institutes" means only the individual teachers / coaching centers / institutes listed on TuitionPTM.in.
1.2. Modification of terms
TuitionPTM.in may modify this agreement's terms and conditions at any time without notice. Continued use of the services and the TuitionPTM.in site after a change in this agreement, or after implementation of any other new policy constitutes acceptance of such change or policy. The User shall be responsible for regularly reviewing these terms and conditions. If you do not agree to the terms of this agreement or any revised version of this agreement, please do not use this website.
All notices and communications (including those related to changes in the Terms & Services, termination of Service etc.) shall be in writing, in English and shall deemed given if delivered personally or by commercial messenger or published on TuitionPTM.in. Notice shall be deemed to have been served 12 hours after it has been sent, dispatched or displayed on website.
1.3. Headings
The headings of each section in this Agreement are only for the purpose of organizing the various provisions under this Agreement in an orderly manner. These headings shall not be used by either party to interpret the provisions contained with them in any manner. Further, the headings have no legal or contractual value.
1.4. Privacy policy
The user hereby consents, expresses and agrees that he has read and fully understands the 'Privacy Policy' of TuitionPTM.in in respect of the website / app. The user further consents that the terms and contents of such 'Privacy Policy' are acceptable to him.
2. Liabilities
2.1. Terms of Services
TuitionPTM.in only provides access to information, services and facilities related to teachers / tuition centers / institutes, offered by different third party service providers ("centers / institutes"). The actual services are provided by the respective service provider.
Information and documents available and published on the website / app is supplied by TuitionPTM.in and, where indicated, by certain third parties. Some of services may have additional and/or supplementary terms, which address the specific rules for the services provided by the service provider. Please go through the specific terms and conditions provided by the respective service provider for use of the services.
We reserves the right to suspend/cancel, or discontinue any or all products or services at any time without notice, make modifications and alterations in any or all of its contents, products and services contained on the site without any prior notice.
TuitionPTM.in reserves the right to remove any materials from the website where it reasonably suspects that such material is prohibited and must not be linked to the website or other websites which are indecent or inappropriate.
You shall establish and use your membership on TuitionPTM.in, and use the services available through TuitionPTM.in, in strict compliance with these Terms of Services and all applicable laws, rules and regulations (collectively, "Laws"). All calls, SMS and other communications between you and TuitionPTM.in may be recorded.
2.2. Limitation of Liabilities
TuitionPTM.in only acts as information provider and a medium to search teachers and institutes; and it shall not have any liability whatsoever for any aspect of the arrangements between the teachers/institutes and the students/guardians as regards to the standard of services / quality of teaching or even behaviour of both parties with each other is not the liability of TuitionPTM.in. We are neither an agent or nor is connected with any party / teacher or institute listed on TuitionPTM.in. TuitionPTM.in disclaims any liability for any information that may have become outdated since the last time the particular piece of information was updated.
TuitionPTM responsibilities DO NOT include:
(i) Teaching quality of teachers or institutes being not upto the mark of students expectations.
(ii) Students information used by teachers or institutes in any way like selling to third parties or storing for their own analysis.
(iii) Students not scoring good marks after paying tuition fees to teachers or institutes connected through us.
(iv) Facilities provided at tuition centre or coaching institute whether mentioned or not mentioned on our platform.
(v) Location of facility or center; the area and number of students being taught at their place.
(vi) Any bad behaviour of teacher with student or vice versa is not our liability because this platform only acts as a bridge to help students and guardians to find teachers around them and we cannot guarantee anything on human nature or behaviour.
(vii) The amount of fees charged by teachers or institutes.
(viii) Any incident occurring at coaching facility or lack of infrastructure required for a coaching center.
(ix) Authenticity or validation of any licenses or legal formalities required by institutes/centers; or any certificates displayed by facilities.
(x) Any kind of other conflict arising between teachers and guardians.
In no event shall TuitionPTM.in be liable for any injury, loss, claim, damage or any special, exemplary, punitive, incidental or consequential damages of any kind, whether based in contract, tort or otherwise, which arises out of or is any way connected with
(a) any use of the services
(b) the TuitionPTM.in site or the TuitionPTM.in content,
(c) the performance or non-performance of any establishment in connection with the services, or
(d) unauthorized access to or alteration of the user's transmissions or data.
In addition, all users specifically understand and agree that any third party directing users to the TuitionPTM.in site by referral, link or any other means is not liable to user for any reason whatsoever, including but not limited to damages or loss associated with the use of the services, the TuitionPTM.in site or the TuitionPTM.in content.
TuitionPTM.in shall not be held responsible for non-availability of the website during periodic maintenance operations or any unplanned suspension of access to the website that may occur due to technical reasons or for any reason beyond TuitionPTM.in's control. In no case the liability shall include any consequential loss, damage or additional expense whatsoever.
2.3. Link to Third Party Sites
TuitionPTM.in may contain hypertext links to Web sites ("Linked sites") operated by parties other than TuitionPTM.in. Such hypertext links are provided for user's only as a convenience, and TuitionPTM.in does not control such websites and is not responsible for the contents of any linked site. TuitionPTM.in's inclusion of any hypertext links to such websites does not imply any endorsement of the material on such websites or any association with their operators.
TuitionPTM.in is not responsible for any errors, omissions or representations on any Linked Site. The users are requested to verify the accuracy of all information on their own before undertaking any reliance on such information.
Third party content, including that posted by our users, does not reflect our views or that of our branches, employees, officers, directors, or shareholders. In addition, none of the content available through the website is endorsed or certified by the providers or licensors of such third party content.
2.4. User Reviews
User reviews or ratings for Teachers and institutes do not reflect the opinion of TuitionPTM.in. TuitionPTM.in receives multiple reviews or ratings for centers by users, which reflect the opinions of the Users. It is pertinent to state that each and every review posted on TuitionPTM.in is the personal opinion of the user/reviewer only. TuitionPTM.in is a neutral platform, which solely provides a means of communication between students and teachers. The advertisements published on the TuitionPTM.in website are independent of the reviews received by such advertisers.
3. User Account
3.1. About Account
In consideration of use of the website, the user represents and confirm that the user is of legal age to enter into a binding contract and is not a person barred from using the website / app and/or receiving the services under the laws of India or other applicable law.
If the user opts to register himself on the website / app, upon completion of the registration process, the user would have created a password. The user agrees and undertakes at all times to be responsible for maintaining the confidentiality of the password, and shall be fully responsible for all activities that occur by use of such password or user's account. You are responsible for the security of your password and for all transactions undertaken using your password through our service. The Password entered by you is transmitted in one-way encrypted form to our database and stored as such. Thus the Password will not be known even to TuitionPTM.in.
TuitionPTM.in website will not be responsible for any financial loss, inconvenience or mental agony resulting from misuse of your ID/password/account details number for using TuitionPTM.in services.
The user also understands that the services may include certain communications from TuitionPTM.in as service announcements and administrative messages. The user understands and agrees that the services are provided on an "as is" basis and that TuitionPTM.in does not assume any responsibility for deletions, miss-delivery or failure to store any user communications or personalized settings.
The user also agrees and undertakes to immediately notify TuitionPTM.in of any unauthorized use of the user's password or account or any other breach of security in order to enable us to take necessary corrective action and TuitionPTM.in shall not be liable for any loss or damage arising from unauthorized use of your account or any breach of security by any third party. User should ensure that the user logs off at the end of each session at the website. TuitionPTM.in shall not be responsible for any, direct or indirect, loss or damage arising out of the user's failure to comply with this requirement.
The User also agrees to:
(a) provide true, accurate and complete information about himself as prompted by the registration form ("Registration Data") on the Website / app; and
(b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete.
If the User provide any information that is untrue, inaccurate, not current or incomplete or TuitionPTM.in has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, TuitionPTM.in has the right to suspend or terminate the User's registration and refuse any and all current or future use of the website and/or any Service.
You also agree that you will not allow any third party to use your account for the purpose of transacting in your name on our website / app.
3.2. Use of Communication
By using services of TuitionPTM.in or after creating an account with TuitionPTM.in site, it is deemed that you have consented to receiving calls, autodialed and/or pre-recorded message calls, e-mails and SMSs from us at any time with the use of the contact information that has been provided by you for the use of this website which are subject to the Privacy Policy. This consent to be contacted is for purposes that include and are not limited to clarification, marketing and promotional calls, e-mails and messages. In case you wish to stop being contacted by us for the same, you may send us an e-mail to the effect at contact@tuitionptm.in
The sharing of the information provided by you will be governed by the Privacy Policy and we will not give out your contact information to third parties not connected with the website / app.
3.3. Termination
Either You or We may terminate the agreement at any time, with or without cause. However, TuitionPTM.in reserve the right, in our sole discretion, to terminate your access to the products and services offered on the Website/App or any portion thereof at any time, without notice and justification.
TuitionPTM.in shall not be liable to you or any third party for any suspension or termination of your access to the reports, products and/or services available through this website, or for any deletion of your account information. All provisions relating to disclaimer of warranties, limitation of liability and remedies and damages contained in the Terms and Conditions shall survive termination.
3.4. Breach
Without prejudice to the other remedies available to TuitionPTM.in under this agreement, the terms and conditions or under applicable law, TuitionPTM.in may limit the user's activity, or end the user's listing, warn other users of the user's actions, immediately temporarily/indefinitely suspend or terminate the user's registration, and/or refuse to provide the user with access to the website if:
(a) the user is in breach of this agreement, the terms and conditions and/or the documents it incorporates by reference;
(b) TuitionPTM.in site is unable to verify or authenticate any information provided by the user; or
(c) TuitionPTM.in site believes that the user's actions may infringe on any third party rights or breach any applicable law or otherwise result in any liability for the user, other users of the website and/or TuitionPTM.in.
TuitionPTM.in may at any time in its sole discretion reinstate suspended users. Once the user has been indefinitely suspended the user may not register or attempt to register with TuitionPTM.in or use the website in any manner whatsoever until such time that the user is reinstated by TuitionPTM.in. Not withstanding the foregoing, if the user breaches this agreement, the terms and conditions or the documents it incorporates by reference.
3.5. Access Restriction
Much of the information on the TuitionPTM.in site is updated on a real time basis and is proprietary or licensed to TuitionPTM.in by its establishments or third parties. The User agrees and undertakes not to sell, trade or resell or exploit for any commercial purposes, any portion of the service.
The user further consent not to use any robot, spider, scraper or other automatic device, process or means to access the TuitionPTM.in site for any purpose without TuitionPTM.in's express written permission. You agree and undertake not to reverse engineer, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the website. Take any action that imposes or may impose (in TuitionPTM.in's sole discretion) an unreasonable or disproportionately large load on our infrastructure. Implement any manual processes to monitor or copy the content from the TuitionPTM.in site without express written permission. For the removal of doubt, it is clarified that unlimited or wholesale reproduction, copying of the content for commercial or non-commercial purposes and unwarranted modification of data and information within the content of the TuitionPTM.in is not permitted and that the website is not for commercial use but is specifically meant for personal use only.
3.6. User Data Security
Transactions on the Website/App are secure and protected. Any information you enter when transacting with the Website/App is encrypted to protect you against unintentional disclosure to third parties.
4. Regulations

At TuitionPTM.in, we try to ensure that all the information on the website is correct, but TuitionPTM.in neither warrants nor makes any claims regarding the accuracy or completeness of any data or information contained. Although information available on the Website is believed to be reliable, TuitionPTM.in make no representation or warranty, express or implied, as to the accuracy or completeness of any information, and data available on the Website, and neither TuitionPTM.in, nor any of its officers, directors, employees, stockholders, owners, affiliates, agents or representatives will have any liability to the other party or any other person resulting from the use of the information, and data copied from the Website.
TuitionPTM.in makes no commitment to update or correct any information that appears on the website. All TuitionPTM.in services are information or products or offers offered by Service Providers and may be available only for a restricted time and only for the available supply as offered by the Service Provider. The information and services included in or available on this website may include inaccuracies or typographical errors.
TuitionPTM.in makes reasonable efforts to ensure that the description and content in the 'Terms & Conditions' page and on each page of the website is correct, it does not, however, take responsibility for errors that may occur due to human or data entry errors or for any loss or damages suffered by any user due to any information contained herein. Also, TuitionPTM.in is not the service provider and cannot therefore control or prevent changes in the published descriptions which are based upon information provided by the teachers / institutes.
You acknowledge and undertake that you are accessing the TuitionPTM.in services on the website and transacting solely at your own risk and are using your best and prudent judgment before entering into any transactions through the Website. TuitionPTM.in is not acting as your advisor or agent.
4.2. Severability
If any provision, or portions thereof, of this Agreement is determined to be invalid or unenforceable in whole or in part under any applicable statue or rule of law, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of this Agreement shall continue to be in full force and effect. In such case, this Agreement shall be reformed to the minimum extent necessary to correct any invalidity, illegality or unenforceability, while preserving to the maximum extent the rights and commercial expectations of the parties hereto, as expressed herein.
4.3. Waiver
The Terms and Conditions and any documents referred to in it, constitute the whole agreement between the parties and supersede any arrangements, understanding or previous agreement or otherwise, whether written or oral, between them relating to the subject matter addressed herein. The failure of either party at any time to require performance of any provision of this Agreement in no manner shall affect such party's right at a later time to enforce the same. No waiver by either party of any breach of this Agreement, whether by conduct or otherwise, in any one or more instances, shall be deemed to be, or construed as, a further or continuing waiver of any other such breach, or a waiver of any other breach of this Agreement.
4.4. Intellectual Property Rights
The Website, its content and/or all intellectual property rights pertaining thereto including the design, text, graphics, logos, images, sound and the selection and arrangement thereof, are either owned by TuitionPTM.in or a third party, and all rights, title and interest therein and thereto shall remain the property of TuitionPTM.in or of the third party. You agree not to use and remove any copyright, trademark or other proprietary notice or legend contained on the Website or its content (or printed copies thereof). All or any third party logos, trademarks, images are the properties of each third party and by using or showing such logos, trademarks and/or images in the website, TuitionPTM.in does not make any representations or claims that such third party logos, trademarks or images are properties of TuitionPTM.in website.

4.5. Partnership
None of the provisions of these Terms shall be deemed to constitute a partnership or agency between you and TuitionPTM.in and you shall have no authority to bind TuitionPTM.in in any form or manner, whatsoever.
4.6. User Obligation
You agree to indemnify, defend and hold harmless TuitionPTM.in and the company, its employees, directors, officers, agents, licensors, suppliers, and vendors from and against any and all suits, losses, claims, demands, liabilities, damages, costs and expenses (including reasonable attorney's fees) arising from or relating to
(i) the misuse of the Website;
(ii) breach of the Terms and Conditions;
(iii) the use of your identifier or password by any person other than the you, being the person to whom such user identifier or user password was assigned; or
(iv) violation of any applicable law, statute, ordinance, regulation or any third party's rights.
This obligation survives the termination of the Terms and Conditions.
In no event shall we be liable to you, or any third party for any special, incidental, indirect, consequential or punitive damages whatsoever, including those resulting from loss of use, data or profits, whether or not foreseeable or whether or not we have been advised of the possibility of such damages, or based on any theory of liability, including breach of contract or warranty, negligence or other tortious action, or any other claim arising out of or in connection with your use of or access to the website/App, services or materials.
We can (and you hereby expressly authorize us to) disclose any information about you to law enforcement or other government officials, as we, in our sole discretion, believe necessary or appropriate in connection with the investigation and/or resolution of possible crimes, especially those that may involve personal injury.
Further, you undertake not to:
(a) Engage in any activity that interferes with or disrupts access to the Website/App or the Services (or the servers and networks which are connected to the Website/App);
(b) Publish, post, disseminate, any information which is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever; or unlawfully threatening or unlawfully harassing including but not limited to "indecent representation of women" within the meaning of the Indecent representation of Women (Prohibition) Act, 1986

(d) You shall not impersonate any other party, create or use an account for anyone other than yourself, provide an email address other than your own, create multiple accounts or business listings except as otherwise authorized by us, or provide or use false information to obtain access to a business' listing on the website/App that you are not legally entitled to claim. You acknowledge that any false claiming of a business listing may us or third parties to incur substantial economic damages and losses for which you may be held liable and accountable
(e) Upload or distribute files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of the Website or another's computer;
(f) Download any file posted by another user of a Service that you know, or reasonably should know, cannot be legally distributed in such manner;
(g) Probe, scan or test the vulnerability of the Website/App or any network connected to the Website/App, nor breach the security or authentication measures on the Website/App or any network connected to the Website/App. You may not reverse look-up, trace or seek to trace any information on any other user, of or visitor to, the Website/App, or any other customer of the website/App, including any website Account not owned by You, to its source, or exploit the Website/App or Service or information made available or offered by or through the Website/App, in any way whether or not the purpose is to reveal any information, including but not limited to personal identification information, other than Your own information, as provided for by the Website/App;
(h) Disrupt or interfere with the security of, or otherwise cause harm to, the Website/App, systems resources, accounts, passwords, servers or networks connected to or accessible through the Website/App or any affiliated or linked sites;
(i) Collect or store data about other users in connection with the prohibited conduct and activities set forth in this Section.
(j) Threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.
(k) Publish, post, disseminate information that is false, inaccurate or misleading; violate any applicable laws or regulations for the time being in force in or outside India;
(l) Directly or indirectly, offer, attempt to offer, trade or attempt to trade in any item, the dealing of which is prohibited or restricted in any manner under the provisions of any applicable law, rule, regulation or guideline for the time being in force.
(m) Create liability for Us or cause us to lose (in whole or in part) the services of our internet service provider ("ISPs") or other suppliers;
(n) You shall not engage in advertising to, or solicitation of, other Users of the Website/App to buy or sell any products or services, including, but not limited to, products or services related to that being displayed on the Website/App or related to us. You may not transmit any chain letters or unsolicited commercial or junk email to other Users via the Website/App. It shall be a violation of these Terms of Use to use any information obtained from the Website/App in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to another person other than Us without Our prior explicit consent.
The limitations and exclusions in this section apply to the maximum extent permitted by applicable law.
4.7. User Generated Content
At TuitionPTM.in, user may submit reviews, comments, and ratings; and submit suggestions, ideas, comments, questions, or other information which is not illegal, threatening, obscene, racist, defamatory, libelous, pornographic, infringing of intellectual property rights, promoting of illegal activity or harm to groups and/or individuals, invasive of privacy, purposely false or otherwise injurious to third parties or objectionable and does not consist of or commercial solicitation, political campaigning, chain letters, mass mailings, any form of "spam" or references to illegal activity, malpractice, purposeful overcharging, false advertising.
If you do submit content, and unless we indicate otherwise, you grant TuitionPTM.in a nonexclusive, perpetual, royalty-free, irrevocable, and fully sub licensable right to use, modify, reproduce, adapt, translate, publish, create derivative works from, distribute, and display such content throughout the world in any media. You represent and warrant that you own or otherwise control all of the rights to the content that you submit; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify TuitionPTM.in for all claims resulting from content you supply.
If your Content is a review, you represent and warrant that you are the sole author of that review; the review reflects a real feeling that you had and you had no financial, competitive, or other personal incentive to author or post a review that was not a fair expression of your honest opinion. In no event shall we assume or have any responsibility or liability for any content posted or for any claims, damages or losses resulting from use of content and/or appearance of content on the Website/App. TuitionPTM.in reserves the right (but not the obligation) to remove or edit such content, but may not regularly review submitted content. Any review posted by a user does not reflect our opinion in any way. Each and every review posted on the website/App is the personal opinion of the user only.
We are a neutral platform and solely provide a means of communication between users. Any advertisements on the website are published on an independent basis and there is no relation between the reviews of advertisers those who have advertised on the website/App. If the business user believes that any particular user's review violates our policy, the user can flag the review to our attention. We may remove the review in our sole discretion.
Subject to the requirements of applicable law, we are not obligated to return any of your content to you under any circumstances. Any review, which is derogatory, defamatory or hateful and without any substantial evidence (e.g. photograph or video) may be taken down at our sole discretion.
4.8. Governing Law
This agreement and each term and condition shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts of Gurugram, Haryana.
5. Other conditions
5.1. Fees Payment
Registration for this website/App is free of cost and will always be free.
5.2. Carrier Rates may apply
By accessing the Services through a mobile or other device, you may be subject to charges by your Internet or mobile service provider, so check with them first if you are not sure, as you will be solely responsible for any such costs incurred.
5.3. Help Centre
We do not operate any live help centre or customer care centre or through chat any way of communication to answer your queries at the same moment in regards to any live order or any issue you are facing in terms of operating TuitionPTM.in website / app. For any help write to us at contact@tuitionptm.in and we will resolve all your concerns and doubts at earliest in our capacity.
5.4. Gift Vouchers/Referrals
Gift vouchers/prizes are issued by TuitionPTM.in and can only be redeemed by authorized user at mentioned establishment as per voucher rules
TuitionPTM.in vouchers are for personal, non-commercial use and enjoyment only. They may be shared with family and friends, but may not be advertised, sold or used as promotional items by the purchaser or anyone else without TuitionPTM.in's prior written consent.
Each Deal/voucher has certain specific terms associated with itself, which will be presented to the user before the voucher allotment. Deal specific terms supersede any inconsistent terms in this Agreement, except to the extent such terms are prohibited by applicable law. The Promotional Period (including, but not limited to, any discounts provided by the website/App) expires on a specific date specified on the website/App. After the expiry date of the Promotional Period, such deals or offers become invalid.
5.5. Eligibility
You represent and warrant that you are competent, at least 13 years of age or older; competent to understand and agree the terms; and eligible to enter into legally binding agreement and have the requisite authority to bind the other party to this Agreement. You shall not use this Website if you are not competent to contract under the Indian Contract Act, 1872 and any other applicable laws, rules and regulations.
